Terms and Conditions - Room Only Bookings - Tolcarne Views
Check in and Check out                                                                                                                                                       1. Your room will normally be available for you from 1600 hours on your scheduled day of arrival.  Please let us know if you are likely to arrive after 2200 hours. Unless we specifically agree otherwise with you, you must vacate your room by 1000 hours on your scheduled day of departure.  If you do not do so, you will be charged for one further night's accommodation.  Room keys /House keys must be returned on departure.
2.  On arrival you will be shown your room and the bathroom and shown how everything functions. You will be given a Room Condition Proforma which we, together, will go through once you have settled in and agree on the room and bathroom condition. This proforma will again be used by both parties prior to your departure and a copy will be retained by both parties.  
Damage Security Deposit  (this can be the most contentious point so is explained in detail.)
3.  A security deposit of £200- will be required but will refunded after your departure subject to a satisfactory checkout.   Under the main Terms and Conditions of the Holiday Lettings Contract you agree not to cause any damage to the walls, ceilings, doors, windows or any other part of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties. You agree to take all necessary steps to safeguard your personal property while at the Property. You agree to ensure that each member of your party is covered by comprehensive travel insurance including loss and damage to your property and mine.
6. Any Damage howeverso occasioned will lead to loss of part or all of your deposit depending on the cost of repair, cleaning and/or replacement.  If the loss or damage is greater than the security-damage deposit the difference will be sought from guests. The deposit does not in anyway limit or waiver further liability. For any damage you may well wish to settle directly before departure.  I reserve the right to take up to 28 days to evaluate the damage and undertake the necessary work required.
7. To be very fair and upfront, please note that any marking (scuffs, scratches, marks) of the walls and ceiling which cannot be lightly cleaned off will result in the loss in part or in full of your damage deposit. This will also apply to the bedding and carpets proportionate to replacement and or professional cleaning costs. 
8. To protect and to satisfy both parties a Room Condition Proforma will be used on accepting the room and at the end of your stay. If you wish to book my room then you are agreeing to my terms and conditions which forms part of our contract in addition to the HolidayLettings Contract. Please take care when staying in the property. All I ask is that you report any incidents as they occur. Thank You for your understanding.
No Smoking Property                                                                                                                                                           8. Smoking is not allowed in the room.  If you smoke in your room, we shall charge you an additional £100 to cover our costs to have the room professionally cleaned. 
Food & Drink                                                                                                                                                                            9. This is a Room Only Offer. Food and refreshments are not allowed in the room. Tea/Coffee facility is available in my kitchen / diner. You may consume refreshments in my kitchen-diner or in the front porch.
10. Footwear - Shoes, Boots to be left in front porch and may not be worn inside main house. You are welcome to walk around in slippers or socks ... it helps save on wear and tear and cleaning costs.
Our liability to you                                                                                                                                                             11. Our total liability to you for any loss you suffer will be limited to the total price of your booking minus website fees. We will not be liable for any losses which were not reasonably foreseeable to both you and us when the contract was entered into, or for any losses that were not caused by any breach of contract or breach of statutory duty or negligence on our part. Nothing in these terms excludes or limits in any way our liability damage caused by negligence, or for fraud misrepresentation, or for any other matter for which it would be illegal or unlawful for us to exclude or limit our liability.
Your liability to us                                                                                                                                                               12. You will be liable for any damage you cause to the room by way of marks on walls, ceiling, carpets, bedding and to any fixtures in the room or bathroom or any other part of the property. 
Events outside our control                                                                                                                                                  13. We shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contract with you that is caused by events outside our reasonable control (such as serious damage to our premises, serious adverse weather conditions, a pandemic or epidemic, or interruption or failure of utility services such as electric power, gas or water).
General                                                                                                                                                                                14. Any error or omission in any information or document issued by us shall be subject to correction provided that the correction does not materially affect the contract.
15. If any court or competent authority decides that any of the provisions of these terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
16. All written communications to us must be sent by post to or by email or to such other address that we may notify to you. We may send written communications to you at either the e-mail or postal address you give us. 
18. These terms shall be governed by English law and shall be subject to the exclusive jurisdiction of the English courts.
