Terms & Conditions Your Contract : The signing of the booking form or after paid in deposit by the group leader confirms acceptance of the terms and conditions set out below and shall be binding on the persons listed on the booking form intending to occupy the premises. No pets allowed and this villa is a NO SMOKING VILLA. Booking:Initial Deposit - An initial deposit of 30% must be paid to confirm a booking. This is non refundable. Full balance and security deposit due 6 weeks prior to arrival date. Cancellations:In the event that you have to cancel your booking at any time it should be noted that no refund would be made whatsoever on the deposit. Any cancellation made by the client for whatever reason shall be in writing. If the booking is cancelled within 3 weeks of the arrival date, the entire rental fee will be forfeit. For cancellations make prior to 3 weeks before arrival date, 50% of the rental fee will be refundable. VALUABLES: Any valuables left at the property are left at one's own risk. SeaPearl Villas nor the owners or staff at the property is responsible for any loss or damage to valuables or other property. The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with SeaPearl Villa are only available to persons who are at least 18 years old. By submitting a booking you warrant and confirm to us that you have read these Terms & Conditions and agree to comply with them. Damage Deposit: The damage deposit of £250 or $US 400 or 12,000 baht will be applied to your credit card or your damage deposit cash when making a balance payment. These charges may include but are not limited to any damages, additional housekeeping, excessive cleaning, missing inventory, missing keys, telephone charge, rental items or additional nights stay etc which will be charged automatically against your damage deposit. Checkouts after 12 am, which have not been pre-arranged, will be subject to a charge against the damage deposit. Any monies due in excess of the damage deposit will be subject to further deduction from your credit card. Check-In: Check-in is 2:00 p.m. unless otherwise arranged with the owner/property manager. An information package will be available at the unit with additional information on the property, which you may find useful. Checkout: Checkout is 12:00 p.m. unless otherwise arranged at least 24 hours in advance of departure. Failure to check out by this time may result in a surcharge to your security deposit. Misuse of the Property: SeaPearl's owners /management team reserves the right to interrupt service and evict guests due to noise complaints or any type of property abuse without a refund. Illegal activities will be cause for immediate eviction by local police. Swimming Pools: Parents of young children may wish to note that the swimming pool and the outside stairs have not been fenced off. This may require a level of supervision higher than one may be accustomed to elsewhere. Liability: Guests are responsible for their villa during occupancy, and must lock windows and doors securely at all times when not on the premises. You must also observe all precautions given by your escort or local contact. The property and its contents will be insured. Any act by a tenant that should negate the insured premises and contents that results in loss, damage to the Owner will be the responsibility of the tenant. Tenants are required to insure their personal possessions prior to occupation. Maintenance: Please notify the owner/property manager as soon as possible if a problem relating to the rental property exists. Every effort will be made to rectify any problem in a timely manner. No refund or rate adjustment will be made for malfunction of air conditioners, TV's, appliances, pool or any other malfunction. Repairs will be made as soon as possible after notification. Suitability: NOT suitable for pets, NOT suitable for wheelchairs, this is a NON–smoking property; kids must be supervised in some areas. Breakages: Our policy is not to charge our guests for individual breakages as we know accidents happen but please let us know via the website or email so that we can replace the item for the next guest. If a large item is broken the cost of replacement will be taken from your deposit but again it would be better to contact the villa manger so we can deal with the problem and let you relax and get back to your holiday. Applicable Law:These Terms and Conditions are governed by and shall be construed in accordance with the laws of Thailand. All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce, Thailand by one or more arbitrators appointed in accordance with the said Rules. Arbitration shall take place within the province of Suratthani, Thailand. Daily rates include: • Minimum stay of 7 nights (14 nights over Christmas and New Year). • Rates shown are for a maximum of 8 Guests. • One airport transfer per villa each way is complimentary, additional trips are 700 baht per trip for up to 7 passengers in a private mini-bus or luxury car. • Baby cot provided free of charge, must requested when booking. Note: ** Daily & Weekly rates are inclusive of all utilities. Services 1. The resident villa staff will ensure the villa is kept clean and tidy during your stay, whilst the English-speaking Manager is available to cater for all of your specific needs. 2. Bed linen is changed every third day, while towels are changed as necessary 3. Pool towels are provided and replenished as deemed necessary
