Ellis Lodge Terms and Conditions In these terms and conditions the following terms have the following meanings: 'Ellis Lodge' is the trading name of Graham and Carol Cottam. 'Accommodation' means the house shown in the confirmation invoice together with the Communal areas or as may otherwise be agreed in writing between Ellis Lodge and the Visitor; 'Agreement' means the agreement between the Ellis Lodge and the Visitor for the holiday rental of Accommodation on these Terms and Conditions; 'Visitor' means the person(s)named on the confirmation invoice. 1. Agreement 1.1. The making of a booking will form an agreement on these Terms and Conditions between the Visitor and Ellis Lodge for the holiday rental of the Accommodation only once the payment of 25% deposit is cleared and your booking is confirmed in writing by letter or e-mail. Ellis Lodge permits the Visitor to occupy the Accommodation for the holiday period shown on the confirmation invoice together with the use of its contents. 1.3 The party leader must be at least 18 years of age at the time of booking and he/she must submit a list of names, addresses and ages of the party to us. 1.4 The Visitor will be responsible for all payments and for any damage whether caused by the Visitor or his/her party and shall make his or her party fully aware of these terms and conditions. 2. Booking and Payment Terms 2.1.For bookings made 8 weeks or more in advance, the booking for a holiday will be effective when a deposit of 25% of the holiday price has been received by Ellis Lodge and written confirmation is received by the Visitor, up to that time the booking will be a provisional booking only. Provisional bookings are normally held for a maximum of 7 working days. The full balance of the total holiday cost will be payable not later than 6 weeks prior to the holiday commencement date and we reserve the right to cancel a holiday where payment has not been received 28 days before the commencement date. If the booking is made within 8 weeks of the holiday start date the full value of the holiday price will be required. Once you have a confirmed booking, you are responsible for the full holiday price even if you subsequently cancel. For bookings made for a holiday less than 8 weeks away, full payment must be made at the time of booking. 2.2 ONLINE BOOKING When you submit a booking via our online reservation system,you will receive an automatically generated booking summary by email to the address you provide in the booking form. This does not form a contract between us. A contract shall arise only when your deposit payment has cleared and your booking is subsequently confirmed in writing via a letter of confirmation sent by post or email. 3.Cancellation 3.1. If a visitor wishes to cancel a booking they must give Ellis Lodge notice in writing as soon as possible. On receipt of the written cancellation Ellis Lodge will endeavour to re-book the Accommodation for the holiday period and if successful for the whole or part of the period, will refund the relevant proportion of the money paid less £30 to cover office administration. If we fail to re-book the Accommodation then the balance of the holiday cost is payable on the due date. 3.2 If, following a booking, the full balance is not paid on time, Ellis Lodge shall notify the Visitor. If, after 28 days from the date on which full payment is due, full payment has not been received by Ellis Lodge then it may cancel the holiday booking and the above cancellation charges will apply and the Visitor remains liable for 100% of the holiday cost. 4. Cancellation Insurance. We remind you that your accommodation booking is a legally binding contract. In the event of cancellation we are entitled to retain your deposit and ask for a further payment to compensate us for our loss. For your protection we suggest that you take advantage of holiday cancellation insurance. This is not compulsory. 4.1 You may select any provider but insurance can be arranged and administered by Rothwell & Towler (authorised and regulated by the Financial Services Authority. FSA Number: 309366.) should you require this. 4.2 If you would like to discuss such insurance with Rothwell & Towler, please let us know at the time of making a booking. You should be aware that by doing so, you agree to us passing your details on to Rothwell & Towler who will then contact you. If you then wish to take out cancellation insurance cover with Rothwell &Towler, you should do so by liaising with Rothwell & Towler directly. 4.3 No introduction is available and you will need to make your own insurance arrangements if a contract is made via a travel agent. 4.4 Where you have taken out cancellation insuranceand cancel a contract with us, the cancellation must be notified to us in writing. Should a cancellation be made which is not covered in full under the terms of the cancellation insurance, you remain liable in accordance with these conditions for any monies owed. 5. Right to Refuse/Alter 5.1. Ellis Lodge may, at its discretion,refuse any booking. 5.2. Ellis Lodge may cancel or alterarrangements made for the Visitor whether before or during the holiday period provided that such cancellation or alteration is necessary: (a) due to circumstances beyond the reasonable control of Ellis Lodge; or (b) to perform or complete essential remedial or refurbishment works. 5.3. If a booking is altered or cancelled by Ellis Lodge it will take reasonable steps to offer a suitable alternative booking. If Ellis Lodge is not able to offer such analternative or the Visitor does not accept the alternative offered, Ellis Lodge will return to the Visitor the relevant proportion of the money paid by the Visitor to Ellis Lodge in respect of the Accommodation and will not otherwise be liable for any loss caused by such alteration or cancellation. 6. Change of Booking 6.1.Transferred bookings are not normally permitted e.g. a change in the Visitor or a transfer from one date to another. 6.2. Ellis Lodge may, at its discretion, accept transferred bookings subject to payment of a fee of £30.00. However, transferred bookings will not normally be accepted within two months of the Visitor's holiday, or from one calendar year to another. 7. Maximum Numbers of Visitors 7.1.Occupation must be limited to the maximum number of persons for the Accommodation as stated on the Ellis Lodge website, in the available beds only, due to local authority and fire regulations. 8.Services 8.1 The holiday price will include all charges for water, electricity, and logs. Visitors must comply with the instructions found in the welcome pack in the Accommodation regarding the stove within the Accommodation. Linen, towels, tea towels are provided. 8.2 For booking of multiple weeks, a weekly change of bed linen is included in the price if required. 8.3 Additional services may also be purchased at the time of booking. 8.4 Charges for telephone usage and premium Sky TV services will be charged at cost once billing details have been confirmed by the service provider. 9. Liability and Loss of Visitor Property 9.1.Ellis Lodge will not be liable for any loss of property or any other loss or damage caused by it or its agents or contractors: a)Unless it has breached a legal duty of care owed to, or contractual term for the benefit of, the claiming party; b) Where such loss or damage is not a reasonably foreseeable result of any such breach;or c) Where such loss or damage results from a breach by the claiming party of any duty of care owed to, or contractual term for the benefit of, Ellis Lodge. 10. Care of the property 10.1.You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair, and in the same clean and tidy condition at the end of the rental period as at the beginning. You must not use the properties for any illegal, dangerous, offensive, noxious, noisy or immoral activities or carry on there any act that may be a nuisance or annoyance to the owner, staff or other neighbouring properties. Smoking is not allowed in any room within Ellis Lodge. 10.2. Note! You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand. 11.Right of Entry 11.1. As with any accommodation, there is a need at times for ongoing and occasionally unforeseen work. Ellis Lodge and its contractors may enter the Accommodation at anyreasonable time for reasonable cause. This includes the need to undertake inspections and audits necessary to operate the business and the undertaking of unforeseen (internal and external) remedial repairs. 11.2. Ellis Lodge will give the Visitor reasonable notice of such requirements, and aims to restrict the working hours of our contractors to between the hours of 10.00 – 15.30. If this is not possible Ellis Lodge will offer reasonable compensation for any foreseeable inconvenience or loss of enjoyment caused on that day. 12. Visitor Obligations 12.1. The Visitor will be responsible for all payments and for any damage whether caused by the Visitor or his or her party. The Visitor agrees to make his or her party aware of these terms and conditions. 12.2. The Visitor agrees to keep and leave the Accommodation and its contents in the same state of repair and condition, and in a clean and tidy state as at the commencement of the booking period (reasonable wear and tear excepted). 12.3. The Visitor must allow Ellis Lodge and/or its agents to enter the Accommodation to inspect the state of it, on reasonable notice, except in emergency when immediate access must be granted. 12.4. The Visitor must not use the Accommodation or allow its use for any dangerous, offensive, noisy, illegal or immoral activities or carry on there any act that may be a nuisance or annoyance to Ellis Lodge its staff or to any neighbours. 12.5. Smoking is not permitted in any part of the Accommodation and the Visitor and any member of his or her party agrees not to smoke inside the Accommodation. 13. Damages and Security Charge 13.1.Ellis Lodge recommends that Visitors hold personal insurance for accidental damage and personal liability. 13.2. The use of the accommodation and amenities at Ellis Lodge is entirely at the users risk and no liability can be accepted for death, injury & loss or damage to users or their belongings. No responsibility can be accepted for loss or damage to belongings or vehicles. This is the Visitors responsibility at all times. 13.3. If on arrival at the Accommodation you discover that anything is missing or damaged then this must be reported to Ellis Lodge immediately otherwise it will be presumed that the damage/loss was caused by you and a charge will be made. 14. Occupation 14.1. The Agreement is personal to the Visitor. The Visitor must not use the Accommodation except for the purpose of a holiday by the Visitor and the Visitor's party during the holiday period and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period. 15. Pets 15.1. No Pets can be accepted in Ellis Lodge. 15.2. Assistance dogs are permitted at Ellis Lodge, however the Visitor must notify Ellis Lodge of the intended presence of any assistance dogs prior to booking. 16.Comments/Complaints 16.1. Every reasonable care will be taken to ensure that the Accommodation is presented to visitors to a high standard. Should the Visitor find on arrival that there is a problem,or cause for complaint, the Visitor should immediately contact Ellis Lodge or its representative. 16.2. Ellis Lodge is committed to ensuring that any problems or complaints the Visitor may have whilst at the Accommodation are resolved efficiently and promptly, but as such must be given the opportunity to do so. Any refusal to notify Ellis Lodge or refusal of reasonable rectification may affect the Visitor's right to compensation or repayment. 16.3. Visitors must provide a contact telephone number and suitable time for Ellis Lodge to communicate with them about problems or complaints. Visitors must allow access to the Accommodation by any staff or contractors of Ellis Lodge to resolve problems or complaints. 16.4. Visitors must formally confirm any unresolved complaint in writing to Ellis Lodge within 28 days of return from their holiday. 17. Arrival and Departure Times 17.1. The Visitor and his or her party must arrive after the arrival time (16:00 on the first day of the holiday period), to allow for cleaning etc and before 17:00 to be greeted on arrival, if arrival will be later than 18:00 , a key to access the property will be left in a coded key box adjacent to the front door, the code for which will be e-mail or sent as an sms prior to your arrival. On the day of departure the departure time is 11:00. Any stay that extends over this period may be subject to a charge being made for additional days. 17.2. The Visitor will be issued with a set of keys to the Accommodation on the first day of the holidayperiod and the Visitor must return them on the last day of the holiday period or the date of departure, if earlier. Failure to do so will incur the cost of a replacement key set and locks when appropriate. 18. Right to Evict 18.1. The Ellis Lodge may terminate the Agreement on notice, and in such case the Visitor and his or her party must leave the Accommodation, (without compensation being payable to the Visitor or any member of his or her party) if: This is deemed necessary by Ellis Lodge where there is a serious breach by the Visitor of the Agreement or the Visitor's or his or her party's behaviour endangers the safety of other visitors or members of staff; or any complaints are made of anti-social behaviour or unreasonable breakages or damage occurs or smoking restrictions are not observed. 19. Circumstances beyond the control of Ellis Lodge (Force Majeure). 19.1. If for any reason we have to cancel your booking in advance due to circumstances beyond our control for example fire, flood, exceptional weather conditions, epidemics, destruction/damage to the property (“force majeure“) you will be refunded the full amount of the booking. If we have to terminate your holiday early for the above reasons you will be refunded part of the booking fee based on the time remaining of the booking. No additional compensation, expenses or costs will be payable. 20. Governing Law 20.1. The construction,validity and performance of the Agreement shall be governed by the law of England and Wales, and both parties submit to the non-exclusive jurisdiction of the UK Courts.
