ii. 'Arrival Date' means the date on which the Booking is due to commence.
iii. 'Booking' means the reservation of a lodge by the Guest.
iv. 'Guest' means the person making the Booking.
v. 'Lodge' means the accommodation for which a Booking is made.
vi. 'Lodge Owner' means the legal owner of the Lodge.
vii. 'Park' means the South Lakeland Leisure Village.
viii. 'Rental' means the total rental charge payable in respect of the Booking.
2. General
i. Irrespective of the number of nights for which a Lodge is actually occupied, the minimum charge for any booking shall be for four nights during the Christmas/New Year period and for three nights at all other times.
ii. The Agent reserves the right to refuse any Booking without explanation.
iii. The Booking shall be subject to these Terms and Conditions and no variation, amendment or addition to these Terms and Conditions shall be valid unless confirmed in writing by a senior manager of the Agent.
3. Payment Terms
i. The lodge holding /security bond payable by the Guest in respect of any Booking is £100.00 per week or part week (i.e. the lodge holding /security bond for any Booking of up to 7 nights will be £100.00, for any Booking of between 8 and 14 nights will be £200 and so on). Provided always that, in the case of any Booking made within 4 weeks of the Arrival Date, the Rental is payable in full when making the Booking in addition to the lodge holding /security bond.
ii. A Booking shall be regarded as provisional until such time as the Rental in full has been received by the Agent in addition to the lodge holding/security bond. Whilst every effort has been made to ensure the accuracy of the information contained in advertising media, until such time as the Booking has been confirmed by the Agent via post or email, the Agent reserves the right to amend any errors and/or omissions in the advertised prices.
iii. The balance of the Rental (together with the £100.00 lodge holding /security bond referred to at clause 4 iii below) must be paid no later than 4 weeks prior to the Arrival Date. The amount thus payable and the date by which it is due will be indicated on the booking confirmation issued in accordance with clause 3 ii above. The Agent does not issue reminders and it is the Guest's responsibility to ensure that the balance of the Rental and lodge holding /security bond are paid by the due date. In the event that the balance of the Rental and the lodge holding /security bond are not paid by the due date, the Booking may (at the sole discretion of the Agent) be deemed to have been cancelled by the Guest and the provisions of clause 3 iv shall apply. Under such circumstances the Guest shall have no claim against the Agent or the Lodge Owner for compensation or reimbursement whatsoever.
iv. Should the Guest for any reason whatsoever cancel his/her Booking, then the lodge holding /security bond or any deposit(s) paid is/are strictly non-refundable. In the case of Bookings cancelled within 4 weeks of the Arrival Date, the balance of the Rental will remain payable and, if it has already been paid, will only be refundable at the sole discretion of the Agent and provided that the Agent is able to re-let the Lodge at not less than the Rental payable by the Guest. It is strongly recommended that the Guest takes out holiday insurance to cover him/her in the event of any such cancellation.
v. Payment may be made by cheque, debit or credit card. Payments made by credit card are subject to an additional charge of 2% of the amount payable.
4. Lodges
i. Lodges are all privately owned (i.e. they are the property of private individuals). The Guest is required to take care to avoid any damage, breakages or losses and to leave the Lodge in the same state of repair, order and cleanliness in which he/she finds it. It is acknowledged that mishaps may occur and the Guest is required to advise the Agent of any damage, breakages or losses as he/she hands back the keys at the end of the Booking.
ii. The Agent reserves the right to charge the Guest, at cost, for any damage, breakages or losses that occur during his/her occupation of the Lodge and/or for any excessive cleaning that may be required. Relevant invoices for any work undertaken and/or materials purchased will be provided. If, on arrival, the Guest discovers any pre-existing damage or breakages to the Lodge or its contents or that any of the advertised contents are missing, he/she should advise the Agent within 24 hours, failing which all such losses, damage or breakages will be considered to have occurred during the Guest's occupation of the Lodge.
iii. A lodge holding /security bond of £100.00 is payable by the Guest together with the balance of the Rental (see clause 3 iii above). The cost of rectifying any damage, breakages or losses that occur during the Guest's occupation of the Lodge and/or of any excessive cleaning that may be required will be deducted from this bond as debt due. In the event that the cost of such rectification exceeds £100.00, the excess amount will be payable on demand by the Guest to the Agent.
iv. For the Guest's convenience and to help keep packing to the minimum, all bedding, towels, soaps, washing up liquid, toilet rolls etc. are provided together with a starter-supply of coffee, sugar, tea and milk. Towels must not be removed from the Lodge and Guests should either provide their own swimming towels or hire them from the leisure centre as and when required.
v. Pets are only accepted in those Lodges indicated as 'pet friendly' in the Lodge description and subject to the Agent's express agreement. To enable the Agent to consider whether or not to accept a pet, the Guest must inform the Agent of the type and breed. Where any pet is admitted to a Lodge an additional charge of £15.00 per pet is payable in advance. The Guest must provide his/her own pet bed and must not allow the pet on any bed or other item of furniture.
vi. Under no circumstances must any pet be left unaccompanied in the Lodge and, if the Guest does so, the Agent may require him/her to vacate the Lodge immediately. Dogs must be kept on a lead at all times within the Park and the Guest must clean up any mess they lodge holding /security bond immediately.
vii. Young all-male or all-female parties are not accepted during main family holiday periods and, at other times, are only accepted at the absolute discretion of the Agent, the Lodge Owner and the owners/managers of the Park. If the Guest's party falls into this category, he/she must declare this to the Agent at the time he/she requests the Booking.
viii. Overcrowding of any Lodge is strictly prohibited as it could negate holiday property insurance. The maximum occupancy for a three bedroom Lodge is six and for a two bedroom Lodge is four. A baby in a cot is the only exception.
ix. The Guest must respect the privacy of the occupants of other lodges and keep noise to a minimum with absolute quiet between 12 midnight and 0800 hours.
x. All Lodges are located within the Park which is separately owned and operated by Pure Leisure Estates Limited. It is the Guest's responsibility to acquaint himself/herself with and abide by the Park Rules, a copy of which can be viewed at the management office close to the Park entrance.
xi. In the event that the Guest fails to comply with any of the above provisions (including but not limited to those set out in the Park Rules) he/she may be refused admission to or required immediately (day or night) to leave the Lodge and the Park. Under such circumstances, the Guest shall be deemed to have cancelled the Booking and shall have no claim against the Agent or the Lodge Owner for compensation or reimbursement whatsoever.
5. Arrival and Departure
i. The Guest may check into the Lodge between 2:00 – 6:00 pm on the Arrival Date and must vacate the Lodge by not later than 10:30 am on the date of departure. Following payment of the balance of the Rental, the Guest should text Maureen as soon as possible on 07957869479 giving his/her name, the Lodge name and his/her expected arrival time to allow the Lodge to be made ready for occupation. The Agent is not based on site and therefore this is the only way for the Guest to obtain his/her key.
ii. Arrivals later than 6:00 pm are by express arrangement only – if the Guest expects to arrive outside the above hours he/she must phone Maureen on the above telephone number to make the necessary arrangements. An additional amount of £20.00, payable in advance, will be charged for late arrivals.
6. Responsibilities and Liabilities
i. It is the Guest's responsibility to ensure that all members of his/her party are aware of, accept and adhere to these Terms and Conditions.
ii. Any personal belongings and vehicles (together with their contents) of the Guest and/or all other members of the Guest's party are left at the Lodge at their own risk.
iii. Neither the Agent nor the Lodge Owner shall be liable to the Guest or any other member of his/her party for any loss, damage or injury howsoever caused to the Guest or his/her personal property (or to other persons in the Guest's party or their personal property) during their stay at the Lodge except to the extent that such loss, damage or injury is caused by the negligence or wilful default of Agent or the Lodge Owner (as the case may be).
iv. Neither the Agent nor the Lodge Owner shall be liable and no compensation shall be paid where the Guest or his/her personal property (and/or any other person in the Guest's party and/or their personal property) suffer any loss, damage, injury, disappointment, inconvenience or otherwise, or where the performance of any obligations by the Agent or the Lodge Owner are prevented or affected by any event and/or circumstance which the Agent or the Lodge Owner could not have reasonably foreseen or avoided including but not limited to war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, flood, adverse weather conditions, non-availability of transport services, interruption to services/utilities, unavailability of area and/or Park facilities and/or amenities and all other events and/or circumstances that are beyond the direct control of the Agent or the Lodge Owner.
